1. Who we are

PORTCYCLING - ASSOCIAÇÃO ("PCA", "we", "us") is registered in Portugal. We operate the community membership at portcycling.pt. Contact: geral@portcycling.pt

2. What data we collect

• Account data: first name, last name, email address, country, phone (optional)
• Payment data: processed exclusively by Stripe — Portcycling never stores card details
• Usage data: pages visited, downloads, session duration (anonymous analytics)
• Communications: emails you send us, support requests

3. Why we process your data (Legal basis)

• Contract performance: to deliver your membership, send training plans, GPX routes, event invitations
• Legitimate interests: to improve the product, prevent fraud, send service updates
• Consent: for marketing communications (you can opt out at any time)
• Legal obligation: financial records as required by Portuguese and EU law

4. Who we share data with

We only share your data with processors who help us deliver the service:

• Stripe — payment processing (Stripe Privacy Policy: stripe.com/privacy)
• TrainingPeaks / Garmin — if you connect your account to our coaching tools
• Email provider — for transactional emails (e.g. Mailchimp or SendGrid)

We do not sell your data to third parties. We do not share data with Canyon, DT Swiss, or Westbike for marketing purposes without your explicit consent.

5. How long we keep your data

• Active membership: for the duration of your subscription
• After cancellation: 3 years (legal/accounting requirements)
• Marketing data: until you unsubscribe

6. Your rights (GDPR)

You have the right to: access your data · correct inaccurate data · request deletion · restrict processing · data portability · object to processing · withdraw consent at any time.

7. Cookies

We use essential cookies (session management) and analytics cookies (Google Analytics, anonymised). You can disable analytics cookies in your browser settings.

8. Complaints

You have the right to lodge a complaint with the Portuguese data protection authority: CNPD (cnpd.pt) or your local EU supervisory authority.

Email: geral@portcycling.pt provides a community cycling membership at portcycling.pt. The membership includes: weekly group rides, monthly training plans, GPX route library (30+ files), private community access, masterclasses, and partner perks (Canyon, DT Swiss, Westbike Store).

2. Eligibility

You must be 18 years or older to purchase a membership. By joining you confirm you are physically capable of participating in cycling activities and accept all associated risks.

3. Membership plans

• Monthly (€29/month): billed every 30 days. Cancel anytime. No minimum term.
• Annual (€150/year): billed once per year. Includes Portcycling club jersey (dispatched within 14 working days of payment). Renews automatically unless cancelled before the renewal date.

4. Cancellation

• Monthly: Cancel anytime via your account dashboard or by emailing hello@portcycling.pt. You retain access until the end of your current billing period. No partial refunds.
• Annual: You may cancel within 14 days of purchase for a full refund, provided the jersey has not yet been dispatched. After dispatch or after 14 days, no refund is available for the remaining subscription period.

5. Partner perks

Partner benefits (Canyon, DT Swiss, Westbike Store) are offered in good faith and may be modified or withdrawn if the partnership agreement changes. Portcycling is not liable for any change in partner terms.

6. Conduct

Members must behave respectfully toward other members, coaches, and partners. Portcycling reserves the right to terminate a membership without refund if a member engages in harassment, discrimination, or behaviour that damages the community or PCA's reputation.

7. Safety & liability

Cycling carries inherent risks. Portcycling provides training guidance but is not responsible for injuries, accidents, or damage occurring during rides or training. Members are responsible for their own insurance and equipment safety.

8. Intellectual property

GPX files, training plans, and other content are for personal use only. Redistribution or commercial use without written permission from PCA is prohibited.

9. Changes to the service

PCA may update pricing, features, or partners with 30 days notice via email. Continued use of the service after the notice period constitutes acceptance of the changes.

10. Governing law

These terms are governed by Portuguese law. Any disputes shall be subject to the jurisdiction of the Portuguese courts in Lisbon.

Client: any individual who accepts this offer by completing the registration and payment process at portcycling.pt ("Member").

1. Subject of the Agreement

The Service Provider agrees to provide the Member with access to the Portcycling Community Membership (the "Service"), which includes the services described at portcycling.pt/membership. This offer is public and constitutes a binding contract upon acceptance (payment completion).

2. Acceptance of the Offer

The Member accepts this offer by: (a) completing the registration form, (b) accepting these terms, the Privacy Policy, and the Terms of Service, and (c) successfully completing payment via Stripe. Acceptance is irrevocable once payment is processed.

3. Service Description

The Portcycling Community Membership includes:

• Access to weekly group cycling rides (road and gravel) in Portugal
• Monthly engineered training plans (4-week periodised blocks)
• Portugal route library: 30+ GPX files downloadable to Garmin/Wahoo devices
• Private community chat and forum
• Masterclasses and networking sessions with professional cyclists and coaches
• 10% discount on all Portcycling training camps and priority booking access
• Partner network access: Canyon exclusive member perks, DT Swiss Europe pricing, Westbike Store partner discounts
• Annual plan only: Portcycling club jersey (one per subscription year)

4. Price and Payment

• Monthly plan: €29.00 (incl. VAT) per calendar month, recurring.
• Annual plan: €150.00 (incl. VAT) per year, billed annually.
• All prices are in EUR. Payment is processed by Stripe Inc. (USA). Portcycling does not store payment card details.
• Prices may be updated with 30 days prior notice to the Member's registered email address.

5. Duration and Termination

• Monthly: The contract is open-ended and renews monthly until cancelled by the Member or the Service Provider.
• Annual: The contract runs for 12 months from the payment date and renews automatically unless cancelled at least 7 days before the renewal date.
• The Service Provider may terminate the contract with immediate effect in case of a material breach by the Member (see Terms of Service §6).

6. Refunds and Right of Withdrawal

As a consumer in the EU, you have a 14-day right of withdrawal from the date of contract conclusion, unless the service has been fully performed with your prior consent. Digital content delivered upon activation (training plans, GPX files) is exempt from the right of withdrawal once accessed.

For the annual plan, a full refund is available within 14 days if the jersey has not been dispatched. Once the jersey is dispatched, no refund applies to the jersey value (€49).

7. Force Majeure

The Service Provider shall not be liable for failure to perform obligations due to circumstances beyond its reasonable control, including natural disasters, pandemic restrictions, or third-party service outages. The Member will be notified within 48 hours and the subscription period extended accordingly.

8. Dispute Resolution

The parties shall first attempt to resolve any dispute amicably via email. If unsuccessful within 30 days, disputes shall be referred to the Portuguese Consumer Arbitration Centre (CNIACC) or, if applicable, the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

9. Applicable Law

This Agreement is governed by Portuguese law and, where applicable, EU consumer protection regulations including Directive 2011/83/EU on consumer rights and Regulation (EU) 2016/679 (GDPR).

10. Entire Agreement

This Agreement, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between the parties regarding the Service and supersedes all prior negotiations, representations, or agreements.
